The family of 28-year-old Evelyn Valdés has filed a lawsuit against the City of Miami, two police officers and others over her death during a police shooting in Wynwood in 2025.

The lawsuit alleges the officers opened fire without giving any warning or verbal commands, escalated the situation and struck multiple bystanders, including Valdés.
Surveillance video obtained by NBC6 appears to show a fight breaking out outside the Electric Lady nightclub around 2 a.m. in June 2025. The footage also appears to show two Miami police officers noticing the altercation before opening fire on an armed man.

Valdés had just left the nightclub, where she had been celebrating her birthday, and was sitting in the back seat of a Mazda SUV when she was struck by gunfire.

“They started shooting without giving any prior warning or verbal command whatsoever,” attorney Ramon Rasco, of Podhurst Orseck, said.
“You have one officer who’s firing over a parallel parked car… that’s violative of internal policy,” co-counsel Angelo Martin, also of Podhurst Orseck, said.
The attorneys also said they have not been able to obtain evidence, including the officers’ body-worn camera footage, because the police investigation remains ongoing.
