As a prominent South Florida real estate developer’s trial nears, the Miami Dade State Attorney’s Office is hoping a judge allows future jurors to be transported out of court to view the damaged boat involved in the 2022 Boca Chita Key crash that killed one teen and left another permanently disabled.\u00a0<\/p>\n

According to records, George Pino is facing second-degree manslaughter and vessel homicide charges for operating in a reckless manner and allegedly causing the death of 17-year-old Luciana Fernandez.\u00a0<\/p>\n

Pino was driving the 29-foot vessel with 14 passengers on board when he crashed into a channel marker near Boca Chita Key on Sept. 4, 2022, according to prosecutors and officials with the Florida Fish and Wildlife Conservation Commission. The boat capsized and all the passengers, including several teens, were thrown into the water.<\/p>\n

Records show Fernandez, a senior at Our Lady of Lourdes Academy in Miami, died from drowning from the injuries she sustained in the crash. Katerina Puig, another passenger who was 18 at the time, was left permanently disabled.<\/p>\n

An initial incident report showed investigators found more than 61 empty alcoholic bottles and cans on the boat. However, a final FWC incident report released nearly a year after the crash indicated that Pino showed no signs of impairment when officers responded.<\/p>\n

Body camera footage\u00a0showed Pino speaking with FWC officers following the crash, with Pino admitting to having two beers, but declining to give a blood sample. Authorities did not give Pino a sobriety test at the time of the crash.<\/p>\n

Could jurors inspect damaged boat for themselves?<\/strong><\/h2>\n

State attorneys are asking Judge Marisa Tinkler Mendez to have the jurors be transported to the FWC location where the damaged 2019 Robalo Boat is currently being housed.\u00a0<\/p>\n

“It is difficult to fully appreciate its size, dimensions, and the ability of an operator of the vessel to see what lies ahead of the vessel without actually seeing it in person,” state attorney Laura Adams mentioned.\u00a0<\/p>\n

In response, Pino’s set of attorneys, which include Howard Srebnick, Mark Shapiro, and Edward Armellino, object to jurors viewing the damaged boat. Instead, they would support jurors viewing an undamaged exemplar of the vessel which would represent how the boat looked before the collision.\u00a0<\/p>\n

Change of Venue?\u00a0<\/strong><\/h2>\n

Additionally, <\/strong>defense attorneys are also asking the judge to move the trial from Miami-Dade County to either Palm Beach County or Orange County, citing the “unfair media attention” Pino has received.\u00a0<\/p>\n

Pino’s attorney claims that if trial happens in Miami-Dade, he will not receive a fair trial.\u00a0<\/p>\n

What’s Next?\u00a0<\/strong><\/h2>\n

None of the above motions have been ruled on including a motion to dismiss request by defense, which is also pending.\u00a0<\/p>\n

In that motion to dismiss, Pino is seeking for his charges to be dismissed or count two be reduced from vessel homicide to a misdemeanor.\u00a0<\/p>\n

A hearing is scheduled for Wednesday, with jury selection expected to begin next week.\u00a0 Pino has pleaded not guilty.<\/p>\n
