The Supreme Court\u00a0ruled President Donald Trump\u2019s executive order limiting birthright citizenship is unconstitutional, striking down a key element of his immigration agenda.<\/p>\n

In a 6-3 opinion, the high court held the order violates the 14th Amendment. Chief Justice John Roberts, , said that children born to parents who are in the United States unlawfully or temporarily are “born in the United States” and “subject to the jurisdiction thereof.” <\/p>\n

“Under the Constitution, they are citizens at birth,” Roberts wrote in his opinion, which was joined by Justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson and Amy Coney Barrett. Justice Brett Kavanaugh joined the court\u2019s majority to strike down the executive order but dissented in part, saying Trump violated federal law, not the Constitution. Kavanaugh’s opinion lays the groundwork for Congress to create birthright exceptions for the children of immigrants by changing the law.<\/p>\n

“Congress can and should address their situation,” he wrote. “The Fourteenth Amendment dictates who must be a citizen, but it does not address who may be a citizen by Act of Congress.”<\/p>\n

Three of the court\u2019s conservative justices \u2014 Clarence Thomas, Neil Gorsuch and Samuel Alito \u2014 dissented.<\/p>\n

In response to the ruling, Trump said the Supreme Court’s decision was “too bad for our Country,” but appeared to heed Kavanaugh’s suggestion that Congress take action through legislation. <\/p>\n

“No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support! President DONALD J. TRUMP,” he wrote on Truth Social.<\/p>\n

The case stems from an executive order Trump signed on his first day of his second term in January 2025 declaring that children born to parents who are in the United States illegally or temporarily are not American citizens. The Constitution\u2019s 14th Amendment, ratified in 1868, and federal law since 1940 confer citizenship on everyone born on American soil, with narrow exceptions for the children of foreign diplomats and those born to a foreign occupying force. <\/p>\n

The 14th Amendment was intended to ensure that Black people, including former slaves, had citizenship, though the Citizenship Clause is written more broadly. \u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside,\u201d it reads.<\/p>\n

Roberts invoked the history of the 14th Amendment, and more recent federal laws, in ruling that anyone born in the country, with very limited exceptions, is a citizen.<\/p>\n

“Citizenship, then and now, was the right to have rights – to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to ‘every free-born person in this land,'” Roberts writes. “We keep that promise today.”<\/p>\n

The League of United Latin American Citizens, one of the plaintiffs in the case, hailed the court’s decision.<\/p>\n

\u201cThis decision confirms a truth that generations of Americans have lived by: a child born on this soil is a citizen of this nation,\u201d Roman Palomares, president of LULAC said in a statement. \u201cThe Court has made clear that no president can override the Constitution by decree.\u201d <\/p>\n

In a 91-page dissent, more than three times as long as Roberts\u2019 opinion, Justice Thomas argued the 14th Amendment “was designed and understood to secure equal rights for the freed blacks” whom he contends were entitled to citizenship because “they were Americans” with “no other homeland” or allegiance to another foreign power. It has “instead been repurposed for political projects that the Reconstruction Congress did not support,\u201d he added.<\/p>\n

Alito argued in a separate dissent that Tuesday’s ruling “confers citizenship on virtually everyone who happens to be born in this country, including the children of ‘birth tourists,’ women who come here solely for the purpose of giving birth to a child and then promptly return home.”<\/p>\n

\u201cBirthright citizenship for children of illegal aliens will continue to be a ballooning negative consequence of the failure to enforce our immigration laws,\u201d said Dale Wilcox, executive director and general counsel of the Federation for American Immigration Reform, a group that support tough restrictions on immigration. \u201cBut that very fact makes it all the more urgent to step up enforcement to the maximum possible extent and end illegal immigration.\u201d<\/p>\n

In a series of decisions, lower courts have struck down the executive order as illegal, or likely so, under the Constitution and federal law. The decisions have invoked the high court’s 1898 ruling in Wong Kim Ark, which held that the U.S.-born child of Chinese nationals was a citizen.<\/p>\n

The Trump administration argues that the common view of citizenship is wrong, asserting that children of noncitizens are not \u201csubject to the jurisdiction\u201d of the United States and therefore are not entitled to citizenship.<\/p>\n

During oral arguments in March, Solicitor General D. John Sauer sought to convince the justices that the 14th Amendment has been misinterpreted and past court rulings and laws passed by Congress mistakenly expanded the definition of birthright citizenship. The court should use the case to set straight \u201clong-enduring misconceptions about the Constitution\u2019s meaning,\u201d Sauer said.<\/p>\n

Both conservative and liberal justices were skeptical of the administrations arguments. Chief Justice Roberts suggested that Sauer was relying on quirky exceptions to citizenship to make a broad argument about people who are in the country illegally.<\/p>\n

More than one-quarter of a million babies born in the U.S. each year would be affected by the executive order, according to research by the Migration Policy Institute and Pennsylvania State University\u2019s Population Research Institute.<\/p>\n

While Trump has largely focused on illegal immigration in his rhetoric and actions, the birthright restrictions also would apply to people who are legally in the United States, including students and applicants for green cards, or permanent resident status.<\/p>\n
