Attorney General James Uthmeier has 10 days to rewrite the ballot title and summary, which the court ruled were “clearly and conclusively defective.”

The issues with the language of the proposed amendment

The title submitted reads: “SAVE OUR HOMES FROM EXCESSIVE PROPERTY TAXES.” The judge ruled that it is “more akin to a political slogan” and is “not fair or neutral.” In its decision, the court refers to a ballot title that was also denied by the Florida Supreme Court in 1994, called “Save Our Everglades.”

About the summary, the judge wrote that its purpose is to “explain what an amendment would do, not to advocate for its adoption.”

But according to the court, as it is currently written, the summary of the tax proposal states that it “benefits Florida taxpayers,” which is the exact question voters are being asked to decide. It also uses “taglines” that are either “political,” “factually inaccurate,” or “misleading.”
