A Texas man has been arrested in the battery of a server at the Hard Rock Cafe at Bayside Marketplace in Miami, police said.

Daniel Ramirez, 47, of Lubbock, was arrested Friday morning at PortMiami on a felony battery charge, records showed.
The incident happened July 26 at the Hard Rock Cafe in the shopping center on Biscayne Boulevard.
According to an arrest report, the server said she was working at the cafe when she spotted the suspect in an employee-only area consuming garnishes intended for drinks prepared at the bar.
She said told him he couldn’t eat them and he replied “B—-, what do you want me to do, spit it out?” the report said.
A short time later, she was called over by her manager after the suspect made a complaint about her and said she needed to be reprimanded, the report said.
“The victim stated that her manager responded by saying, ‘look like I am reprimanding you, as the defendant made a complaint for what you told him at the bar,'” the report said.

Afterwards, as the server was going to speak with a fellow employee, she said the suspect shoved her, causing her to fall into a metal garment rack and chip one of her front teeth, the report said.
The suspect ran out of cafe and she followed, taking photos of him, but she said he turned around and struck the phone out of her hand, pushed her in the face and caused her to fall to the ground and lose consciousness, the report said.
Part of the incident was captured on surveillance video.
Officers responded and tried to speak with family members who’d stayed at the man’s table but they refused to cooperate, the report said.
A Crime Stoppers tip was submitted identifying a possible defendant and when they searched Ramirez’s name it confirmed a possible match for the suspect, the report said.
The victim later identified Ramirez as the suspect in a photo lineup, the report said.
When Ramirez was arrested at the cruise terminal, he spontaneously said he had “run into a lady,” the report said.
